Top 5 Reasons to Include Probate Avoidance Tools and Strategies in Your Estate Plan

Probate is the legal procedure through which a decedent’s estate is administered, debts are paid, and assets are distributed to beneficiaries and/or heirs of the estate. While probate serves an important function, it can be a time-consuming and costly process that people often try to avoid when creating their estate plan. With that in mind, allow me to explain the top five reasons why you should consider including probate avoidance tools and strategies in your estate plan.

  1. Speedier Distribution of Assets. One of the primary advantages of probate avoidance is that it allows for a much quicker distribution of assets to your beneficiaries. Probate takes months, even years, to complete, depending on the complexity of the estate and the efficiency of the court system. During this time, your beneficiaries may be left waiting to access the assets you intended for them. By using probate avoidance tools such as living trusts, you can ensure that your assets are transferred to your loved ones quickly and without unnecessary delays.
  2. Reduced Legal Costs. The probate process often comes with significant legal fees and court costs, which can diminish the value of the estate passed down to loved ones. By taking steps to avoid probate, you can minimize these costs and preserve more of your estate for your loved ones. Tools like living trusts and transfer-on-death accounts can help you bypass the probate process, thereby reducing the financial burden on your estate and ensuring that more of your assets go directly to your beneficiaries.

If your estate is tied up in probate, those who depend on your assets may face financial difficulties while waiting for the process to be completed. By incorporating probate avoidance tools into your estate plan, you can provide for your loved ones without interruption. For example, a living trust allows your chosen Trustee to manage and distribute assets immediately upon your death, ensuring that your beneficiaries have access to the funds they need when they need them most.
